New anti-bullying powers granted to Fair Work Commission
New powers granted to the Fair Work Commission to tackle workplace bullying are now in force as of the 1 January 2014. Changes to the Fair Work Act permit the Fair Work Commission to directly prosecute workplace bullies with fines of up to $10,200 for individuals and up to $51,000 for employers, found to have breached the law.
As result of the improved legislation, employees can now apply to the Fair Work Commission to have an order issued stop workplace bullying for an application fee of $65.50 with fines for both individual bullies and employees who fail to heed such an order.
If applied appropriately, this additional legislation has the potential to provide significant protections to the victims of workplace bullying which have previously not been afforded.
Victims of CSIRO will be monitoring any such matters brought before the Fair Work Commission with great interest.
